ASIC Fines Mona Museum Owner $198,000 for Late Financial Report
Downward Spiral Enterprises, the corporate entity behind Tasmania’s Mona museum, has been issued a $198,000 infringement notice by the Australian Securities and Investments Commission (ASIC) for failing to lodge its financial report on time. The penalty is part of a broader regulatory crackdown on late filings among large proprietary companies.
The company was one of 22 large firms penalized in this recent enforcement wave, contributing to $4.3 million in total fines collected by the regulator. ASIC emphasized that payment of these notices does not constitute an admission of guilt but serves as a deterrent against non-compliance.
Digital Walsh, the sole director of Downward Spiral Enterprises, which also owns Moorilla Estate and operates Mona, lodged eight years of accounts with ASIC in June. This submission revealed financial details for the first time since 2019. The records showed that dividend income exceeding $695 million supported Mona and other businesses within Walsh's portfolio, including Moo Brew beer maker and DarkLab, which runs the Dark Mofo festival.
Downward Spiral reported a profit of $63.9 million for the 2024–25 financial year, largely driven by a $114 million dividend from an undisclosed source. Despite this recent profitability, Mona has accumulated losses totaling $408 million since its opening in 2011. Walsh previously stated he was "completely happy with the finances" despite these figures.
ASIC Commissioner Kate O'Rourke stated that timely reporting provides crucial information to shareholders and creditors. She warned that enforcement actions send a clear message that non-compliance will not go undetected. The commission engaged with 234 companies regarding financial reporting obligations this year, including 193 that allegedly failed to lodge reports for 2025. Of these, 147 have since lodged outstanding reports.
Common reasons cited for non-compliance included audit-related issues, administrative oversight, and inadequate resources. Some companies were unaware of their obligations until contacted by ASIC.
