Competitor's 18-Month Attempt to Dissolve Botanical Terpene Brand Fails; Appeal Filed and Dropped
DENVER, CO / ACCESS Newswire / March 17, 2026 / Terps USA, LLC, a leading manufacturer of botanical terpene sprays and application hardware, announced today that a Colorado District Court jury has fully cleared the company of trademark infringement and civil theft claims brought by a competitor. The verdict concludes an 18-month legal battle in which the plaintiffs sought approximately $985,000 in damages and the permanent dissolution of Terps USA as a business.

The jury deliberated for approximately 30 minutes following a multi-day trial before returning a verdict finding no liability and awarding zero damages to the plaintiffs on those claims.
The lawsuit (Case No. 2023CV32008 ), filed in October 2023 by Anton Neznamov and Liquidizer, LLC (makers of Wax Liquidizer), spanned six separate legal claims against Terps USA, LLC and its founder, Kenneth Fry. Over the course of 18 months, the plaintiffs extended the proceedings while seeking to hold Terps USA liable for trademark infringement and attempting to force the equitable dissolution of the company.
On April 3, 2025, the jury rejected the core claims. In the subsequent Entry of Judgment, District Court Judge Benjamin Todd Figa formally denied the plaintiffs' request to dissolve the company, writing:
"The preponderance of the evidence did not show that Defendant Kenneth Fry has - with respect to Terps USA LLC - committed misconduct... This business remains viable to operate and is financially profitable."
Following the sweeping judgment in favor of Terps USA, the plaintiffs filed an appeal - and subsequently dropped it, ending the matter entirely.
